  1. Google clobbers Cyanogen's modded builds. Interesting. This article has both good links to all the key points and articles and good commentary
  2. Dan Ravicher is named lawyer of the week. You can read an expanded version of that phrase if you pay a whole bunch of money to some law journal. I didn't. Congrats Dan!
  3. I believe the number but I think it's not true to say that each C&D letter translates into payment. My general understanding is that these letters are being used as a way of getting ISPs to turn users off, not to extra money directly.
  4. " An appeals court agreed, with Judge Alex Kozinski saying, "With fame often comes unwanted attention." Noting the often bitter tone taken by companies in this five-year legal battle, Kozinski ordered both sides to behave. "The parties are advised to chill," he said in his ruling."
  5. "Trying to shift the burden of proof back onto themselves, I asked why they don't contribute to the open-source projects from which they derive so much value. Many indicated that it's too hard to contribute back to open-source projects due to internal legal issues and the high bar to knowing how to contribute. They suggested that they would instead prefer to pay the open-source companies to do that work for them."
  6. Mostly a summary of how the CAFC is out of line in its strong support for pantents: "So, it is with only slight satisfaction that I report the Supreme Court yesterday accepted another patent case. This is another instance where the CAFC went far beyond merely interpreting the patent statute in order to benefit patentees and harm the public. I am confident it will be another instance where the Supreme Court will correct the CAFC."
  7. "In his remarkable ruling, U.S. Circuit Judge Richard Posner stated that there was no point in holding a trial because it was apparent that neither side could show they had been harmed by the other’s patent infringement. He said he was inclined to dismiss the case with prejudice — meaning the parties can’t come back to fight over the same patents — and that he would enter a more formal opinion confirming this next week."
  8. This seems like a pretty crazy decision. Bad news for Germans until this gets appealed out of existence.

  15. The most interesting part, I think, is that the porn industry is actively involved in copyright litigation. I have often held them up as an example of an industry who didn't have litigation as an option and, as a result, had to be more creative.
